Welcome to FixPilot. By downloading, installing, or using the FixPilot mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Description of Service

FixPilot is an AI-powered home repair diagnostic tool that helps users identify potential causes of home maintenance issues and suggests possible repair approaches. The App provides informational guidance only.

2. Important Disclaimers

• Not Professional Advice. FixPilot provides AI-generated suggestions for informational purposes only. The App does not replace licensed contractors, electricians, plumbers, or other qualified professionals.
• No Warranty of Accuracy. AI-generated diagnoses and repair plans may be inaccurate, incomplete, or inappropriate for your specific situation. Always verify with a qualified professional before undertaking repairs.
• Safety Risk. Home repairs can involve serious hazards including electrical shock, water damage, structural failure, gas leaks, and fire. Never attempt repairs beyond your skill level. When the App identifies a safety concern, follow its recommendation to contact a professional.
• No Liability for Damages. You assume all risk when acting on information provided by the App. FixPilot and its developers are not liable for any property damage, personal injury, or other losses resulting from use of the App.

3. User Accounts

You must create an account to use the App. You are responsible for maintaining the confidentiality of your login credentials. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.

4. API Keys (Bring Your Own Key)

Certain AI features require an API key from a third-party AI provider (e.g., OpenAI, Anthropic). You are responsible for:

• Obtaining and paying for your own API key
• Complying with the third-party provider's terms of service
• Any charges incurred through your API key usage
• Keeping your API key secure

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Upload malicious content, malware, or attempt to compromise the service
• Share your account credentials with others
• Use the App to provide professional contracting or inspection services without proper licensing

6. Intellectual Property

The App, its design, code, and content are owned by FixPilot and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

8. Photos, Videos, and Media

When you upload photos, videos, or audio recordings to the App, you grant FixPilot a limited license to process this media for the purpose of providing diagnostic services. Your media is not shared with third parties except as necessary to provide the AI diagnostic service (e.g., sending images to AI providers for analysis).

9. Service Availability

We strive to maintain the App's availability but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify or discontinue the service at any time.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXPILOT AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, PERSONAL INJURY, LOSS OF DATA, OR LOSS OF PROFITS, ARISING FROM YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless FixPilot and its developers from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or any repairs or actions you undertake based on information provided by the App.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify users of material changes through the App.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.
